End User License Agreement NANO Antivirus

  1. Definitions and Terms

    1. This License Agreement is an agreement between you, the End User (an individual), and BI.ZONE LLC (OOO «БИЗон»), the rights holder of the NANO Antivirus software product. The License Agreement is concluded with respect to the above software product. This software product is provided and used under the terms of this License Agreement and includes software, as well as related media, printed materials, electronic documentation, applications, and other components (hereinafter the Product).
    2. NANO Antivirus is a software product designed to protect a personal computer (PC) from malicious software.
    3. Standard License means a license type that allows installation of the Product on a predetermined number of devices for a predetermined term.
    4. Dynamic License means a license type that allows installation of the Product on several devices in accordance with the rules for using such licenses, while the license term may change.

  2. Conclusion of the License Agreement and Grant of Licenses

    1. By installing, copying, or otherwise using the Product, you confirm that you have read the License Agreement, understand its terms, and agree to use the Product in accordance with it.
    2. The License Agreement is considered concluded from the moment you begin using the Product or from the moment you accept all terms of this License Agreement by expressly agreeing to the terms of this agreement by selecting the corresponding option during installation or the first launch of the Product.
    3. If you do not agree with any part of the License Agreement, you may not use the Product and must immediately stop using it. BI.ZONE LLC may unilaterally amend the License Agreement at any time without any notice to the End User. The new version of the License Agreement enters into force when it is published at www.nanoav.ru.
    4. BI.ZONE LLC grants you a simple (non-exclusive) License to use the Product. The right to use the Product includes the following methods of use: installation and launch of the Product in computer memory subject to the restrictions provided by the License Agreement, provided this does not contradict the Product functionality; use of the Product functionality with the right to receive the result of using such functionality.
    5. If the End User violates the terms of this License Agreement, BI.ZONE LLC may unilaterally refuse to perform the License Agreement and terminate the License without compensating the End User for any losses.
    6. BI.ZONE LLC reserves the right to terminate the License if bankruptcy or liquidation procedures are initiated against BI.ZONE LLC, or if activities related to the development and/or support of the Product are terminated.

  3. Use of the Product

    1. The Product provided to you under this License Agreement may be used only for the term and on the number of PCs determined by the license. This term may be extended at the initiative of BI.ZONE LLC as part of marketing activities. If several operating systems are installed on a PC, including virtual environments, each of them is counted as a separate device.
    2. You agree that the total number of protection days for all devices on which a Dynamic License is activated may not exceed the sum of the nominal value of the Dynamic License and any bonus days received.
    3. NANO Antivirus is intended exclusively for personal (non-commercial) use on home PCs.
    4. The Product may be provided on several media, including via the Internet. Regardless of the number of media on which you received the Product, you may use only the number of copies corresponding to your License for the Product.
    5. Files received from end users are checked for malicious code in order to provide the user with an online verdict on the submitted file or to make changes to virus databases without additional notice to the user.
    6. Technical information is used to identify problems encountered by the user and to suggest ways to resolve them. Received files and technical information may also be subject to additional analysis and used for statistics, Product improvement, and similar purposes without additional notice.

  4. Intellectual Property and Copyright

    1. The Product and all of its components, including documentation, trademarks, graphics, etc., as well as algorithms and operating principles, are intellectual property of BI.ZONE LLC and are protected by applicable Russian and international laws. Use of such intellectual property objects separately from the Product is prohibited.
    2. BI.ZONE LLC warrants that it has all necessary rights to license and distribute the Product.

  5. Restrictions on Use

    1. The User is prohibited from:
      • Using the Product in any way not provided for by the License Agreement, including modifying or making any changes to the Product and its parts, or using the Product and its parts to create derivative or composite computer programs;
      • Using the Product as part of other software products, including services;
      • Circumventing or attempting to circumvent technical restrictions and Product protection mechanisms;
      • Decompiling, disassembling, reverse engineering, decrypting, studying, or otherwise attempting to obtain the source code or internal structure of the Product;
      • Developing or creating, based on the Product, proprietary software that partially or fully duplicates software functions, algorithms, or ideas;
      • Taking actions aimed at testing, analyzing, or assessing Product vulnerabilities without the prior written consent of BI.ZONE LLC;
      • Distributing, selling, renting, sublicensing, placing in public sources, or otherwise providing the Product distribution package or the right to use the Product to third parties;
      • Using software tools to access the Product for the purpose of extracting, collecting, processing, copying, and/or subsequently distributing information and data presented or stored in the Product;
      • Using malicious software or taking actions aimed at disrupting the operability and functioning of the Product;
      • Using the software in violation of the law or the rights and legitimate interests of third parties, in particular using the Product on third-party devices without their consent;
      • Using the Product to provide services to third parties, including information security services;
      • Using the Product to perform actions aimed at compromising the security, stability, or availability of the IT infrastructure of BI.ZONE LLC and third parties;
      • Removing or modifying copyright notices contained in the Product.
    2. Upon termination of use of the Product, but in any case no later than 1 business day after the end of the software use term, the User must completely delete it from their device, including connected storage media. Deletion is performed by uninstalling the Product using standard operating system tools. The End User must also delete any copies of distribution packages, installation packages, and backup copies of the Product in their possession, and must reasonably ensure that the End User device file systems are cleared of residual files, temporary files, and directories created during installation or use of the Product.

  6. Disclaimer

    1. The Product and all of its components, including updates, are provided on an “as is” basis.
    2. BI.ZONE LLC provides no warranties for the Product, and you use it at your own risk. Under no circumstances does BI.ZONE LLC bear any liability for damage caused as a result of using the Product, including lost profits.
    3. BI.ZONE LLC does not guarantee that the Product will work on operating systems whose official support has been discontinued by the manufacturer.
    4. BI.ZONE LLC does not guarantee that the Product will work on operating systems whose manufacturers have imposed restrictions on interaction between the OS and the services and applications included in it with third-party software, in any form and for any reason.
    5. The Product is provided in accordance with the “as is” principle. The Company makes no warranties and is not liable for such consequences arising during use of the Product as error-free, uninterrupted, and fast operation of the Product, accuracy and reliability of Product use results, the Product not meeting the User's expectations, compatibility of the Product with other software, or functioning of the Product on third-party devices and equipment.
    6. The End User independently ensures the availability and proper functioning of their device required to use the Product, including hardware, software, operating systems, communication channels, and Internet access. The Company is not liable for inability to use the Product caused by defects or non-compliance of such device.
    7. Circumstances beyond the reasonable control of BI.ZONE LLC, including failures in communication networks, data centers, software, operating systems and equipment of third parties, actions of telecommunications operators, Internet access providers, owners and administrators of information systems and resources, are not considered a breach of BI.ZONE LLC obligations and do not entail its liability.
    8. The Company is not liable for losses arising in connection with use or inability to use the Product, including data loss, lost profits, and other indirect losses. Nothing in this Agreement limits the liability of BI.ZONE LLC in cases where such limitation is prohibited by law.
    9. The End User is solely responsible for their actions performed when using the Product. BI.ZONE LLC is not liable for the consequences of the End User's use of the software. If claims are brought against BI.ZONE LLC by third parties, including government authorities, in connection with the End User's use of the Product, in particular in violation of the License Agreement, the End User must independently and at their own expense settle such claims and compensate BI.ZONE LLC for any losses caused.

  7. Warranty Support

    1. During the term of the granted right to use the Product, but in any case for no more than 12 months from the start date of such Product use term, BI.ZONE LLC may provide the End User with warranty support for the Product, limited to the following actions: remedying defects in the Product; providing patches and/or Product updates for the purposes of warranty support of the Product. Defects mean non-conformities of the Product (including its operability, functionality, and composition) with the requirements and provisions specified in the technical documentation that prevent normal operation of the Product. The time frame for handling a warranty support request is determined by BI.ZONE LLC.
    2. BI.ZONE LLC provides warranty support for Product users at the following address: support@nanoav.ru.
    3. Warranty support for NANO Antivirus begins on the date of the first activation of the first of the transferred licenses, regardless of the activation method.
    4. All issues related to the use of Dynamic Licenses, including license deactivation, license activation errors, and other issues, are resolved exclusively through the BI.ZONE LLC warranty support service.

  8. Privacy Policy

    1. BI.ZONE LLC carefully handles any information received from our users. The Privacy Policy is published at the specified address.

  9. Governing Law

    1. Relations under the License Agreement are governed by the applicable laws of the Russian Federation.
